{"id":670,"date":"2004-05-04T10:00:35","date_gmt":"2004-05-04T17:00:35","guid":{"rendered":"http:\/\/www.artsjournal.com\/herman\/wp\/2004\/05\/pen_sends_a_letter\/"},"modified":"2004-05-04T10:00:35","modified_gmt":"2004-05-04T17:00:35","slug":"pen_sends_a_letter","status":"publish","type":"post","link":"https:\/\/www.artsjournal.com\/herman\/2004\/05\/pen_sends_a_letter.html","title":{"rendered":"PEN SENDS A LETTER"},"content":{"rendered":"<p><P><A href=\"http:\/\/www.pen.org\/\"><B><EM><FONT color=#003399>The PEN American<br \/>\nCenter<\/FONT><\/EM><\/B><\/A> has called for the current occupant of the White House &#8220;to<br \/>\nabandon Patriot Act politics&#8221; and lead &#8220;an open, bipartisan evaluation of individual provisions of<br \/>\nthe Act that are scheduled to end by 2005, including Section 215, which opens records of<br \/>\nindividual reading activities to government scrutiny.&#8221;<\/P><br \/>\n<P>Good luck.<\/P><br \/>\n<P>Section 215, in case you don&#8217;t remember, amended and greatly expanded the scope of the<br \/>\n1978 <A href=\"http:\/\/www.fas.org\/irp\/agency\/doj\/fisa\/\"><B><EM><FONT\ncolor=#003399>Foreign Intelligence Surveillance Act<\/FONT><\/EM><\/B><\/A>. The FBI now<br \/>\nhas the right to examine &#8220;any tangible things&#8221; &#8212; to quote the law &#8212; including bookstore and<br \/>\nlibrary records, PEN said in a press release issued Monday. <\/P><br \/>\n<P>Under Title II, Section 215, of the <A\nhref=\"http:\/\/www.epic.org\/privacy\/terrorism\/hr3162.html\"><B><EM><FONT\ncolor=#003399>USA Patriot Act<\/FONT><\/EM><\/B><\/A>,&nbsp;investigators can seek<br \/>\nrecords even of individuals not suspected of terrorism. It also has a gag provision that prevents<br \/>\ninstitutions from disclosing that their records have been examined. <\/P><br \/>\n<P>&#8220;Like many sectors of the literary community,&#8221; PEN &#8220;fears that such sweeping authority<br \/>\nthreatens the privacy necessary for law-abiding citizens and residents to explore controversial<br \/>\ninformation and ideas.&#8221;<\/P><br \/>\n<P>The PEN American Center is an association of more than is 2,600 writers and editors. It is<br \/>\nthe largest of nearly 130 PEN Centers worldwide that compose International PEN, which has<br \/>\npromoted literature and protected <A\nhref=\"http:\/\/www.pen.org\/freedom\/ran.htm\"><B><EM><FONT color=#003399>freedom of<br \/>\nexpression<\/FONT><\/EM><\/B><\/A>&nbsp;for more than 80 years.<\/P><br \/>\n<P>The sunset provisions of the Patriot Act, says Larry Siems, the director of PEN&#8217;s Freedom to<br \/>\nWrite and International Programs, &#8220;were built in to ensure that Congress would look carefully<br \/>\nboth at how the elements of the law are working to thwart terrorism and whether particular<br \/>\nprovisions are compromising essential liberties.&#8221;<\/P><br \/>\n<P>PEN has sent a letter to the White House &#8220;endorsing strong, targeted measures to confront<br \/>\nterrorism and prevent terrorist attacks,&#8221; but also &#8220;pressing for refinements and improvements to<br \/>\nthe Patriot Act and other post-9\/11 security measures to protect privacy, ensure public access to<br \/>\ngovernment information, and comply with international law and human rights covenants.&#8221;<\/P><br \/>\n<P>The letter, co-signed by PEN American Center President Salman Rushdie, asks the current<br \/>\noccupant of the White House to &#8220;protect and promote a critical and open review of the sunset<br \/>\nprovisions, one that acknowledges the shared commitment of all participants to the security and<br \/>\nsafety of U.S. citizens, residents, and interests and that allows for changes born of wisdom and<br \/>\nexperience.&#8221;<\/P><br \/>\n<P>The Maximum Leader is doubtless all ears.
