I mean the <a href=\"http:\/\/www.artsjournal.com\/herman\/archives\/2006\/03\/the_copycat_and_1.html\" class=inline target=new\"><strong><font color=#003399>Copycat and the Original Cat<\/strong><\/font><\/a>, which I&#8217;ve already referred to twice before, <a href=\"http:\/\/www.artsjournal.com\/herman\/archives\/2006\/04\/copycat_redux.html\" class=inline target=new\"><strong><font color=#003399>here<\/strong><\/font><\/a> and <a href=\"http:\/\/www.artsjournal.com\/herman\/archives\/2006\/06\/copycatting_one_1.html\" class=inline target=new\"><strong><font color=#003399>here<\/strong><\/font><\/a>. But Randy Kennedy&#8217;s item, &#8220;Photographer Wins Suit Against Designer,&#8221; in the <a href=\"http:\/\/www.nytimes.com\/2007\/05\/16\/arts\/16arts.html?_r=1&#038;ref=arts&#038;oref=slogin\" class=inline target=new\"><strong><font color=#003399>Arts Briefly<\/strong><\/font><\/a> column of The New York Times, revived the issue for me &#8212; particularly his description of the plagiarism involved.<br \/>\n<a href=\"http:\/\/www.designboom.com\/portrait\/klein.html\" class=inline target=new\"><img decoding=\"async\" alt title=\"From 'Paris' photographs by William Klein, 2002 [Courtesy Palazzo delle Esposizioni, Rome]\" src=\"http:\/\/www.designboom.com\/portrait\/klein\/1.gif\" width=220 align=right border=0 \/><\/a>A French judge ruled that John Galliano&#8217;s fashion ads &#8220;too closely mimicked a technique&#8221; created by William Klein. <i>(An example of Klein&#8217;s technique, right.)<\/i> In other words, the plagiarism did not involve an exact image but rather the imitation of a style &#8212; or as the <a href=\"http:\/\/www.iht.com\/articles\/ap\/2007\/04\/19\/europe\/EU-GEN-France-Designer-Plagiarism.php\" class=inline target=new\"><strong><font color=#003399>Associated Press put it<\/strong><\/font><\/a>, &#8220;[the judge] said the ads clearly violated intellectual property laws because Galliano never asked Klein&#8217;s permission to use the style, which the New York-born photographer developed more than a decade ago.&#8221;<br \/>\nThe parallels to the case of a Vik Muniz fashion spread in The New York Times <i>Style<\/i> Magazine, which imitated the technique <i>and<\/i> the imagery of the artist Norman O. Mustill, are so close that it&#8217;s bizarre. Here&#8217;s some of the evidence one more time, as quoted from the original Muniz-Mustill item of March 13, 2006:<\/p>\n<p><!--more--><br \/>\nExhibit A: On the left, Mustill (from 39 years ago). On the right, Muniz (from three months ago). In this case, notice the exact material: tree branches within a human form in the context of a fashion statement and the referential hand.<br \/>\n<P><a href=\"http:\/\/dogbert.abebooks.com\/servlet\/BookDetailsPL?bi=290087550&#038;searchurl=bx%3Doff%26sts%3Dt%26ds%3D30%26bi%3D0%26an%3Dnorman%2Bmustill%26tn%3Dflypaper%26sortby%3D2\" class=inline target=new\"><img loading=\"lazy\" decoding=\"async\" alt title=\"IMAGE BY MUSTILL\" src=\"http:\/\/www.artsjournal.com\/herman\/archives\/Mustill%20EXHIBIT%20A.jpg\" width=\"200\" height=\"269\" \/><\/a><a href=\"http:\/\/www.nytimes.com\/slideshow\/2005\/11\/30\/style\/tmagazine\/20051201_MUNIZ_SLIDESHOW_4.html\" class=inline target=new\"><img loading=\"lazy\" decoding=\"async\" alt title=\"IMAGE BY MUNIZ\" src=\"http:\/\/www.artsjournal.com\/herman\/archives\/Muniz%20EXHIBIT%20A.jpg\" width=\"200\" height=\"268\" \/><\/a><\/P><br \/>\nAnd that&#8217;s just Exhibit A.<br \/>\nPerhaps more bizarre than the &#8220;paraparallels&#8221; between Galliano-Klein and Muniz-Mustill is the fact that the <a href=\"http:\/\/www.slate.com\/id\/2141404\/\" class=inline target=new\"><strong><font color=#003399>dreadful former public editor of The Times<\/strong><\/font><\/a> never responded to my complaint. The editors of the NYT Style Magazine published the Muniz spread, undisturbed, and it&#8217;s too damned expensive to sue.<br \/>\nWithout seeing the incriminating Galliano ad spread, which I can&#8217;t find online, I&#8217;m drawing conclusions based on words. If anybody has the spread, please let me or my staff of thousands know. It would be much appreciated.
